Rogue pharmacies violate federal law by shipping abortion pills across state lines

March 11, 2024, WASHINGTON, DC — On Monday, Human Coalition Action led a coalition of leading national pro-life groups in asking members of Congress to send cease-and-desist letters to pharmacies illegally mailing or shipping abortion drugs across state lines. Doctors are also using state pro-abortion “shield laws” to claim immunity for smuggling abortion drugs into states with life-affirming laws.

Human Coalition Action’s President Jeff Bradford led the letter to members of Congress, naming the online pharmacies that are illegally mailing or shipping abortion drugs across state lines: Honeybee Health, Manifest Rx, and American Mail Order Pharmacy. Their letter also names four providers that illegally smuggle abortion pills into states with pro-life laws, violating both state and federal laws: Aid Access, Cambridge Reproductive Health Consultants, Abuzz, and Honeybee Health.

Human Coalition Action asks members to hold accountable these rogue organizations which are brazenly violating federal and state laws and recklessly endangering women and children.

“These groups are responsible for ushering in a horrific new abortion world for vulnerable women and their children—a world where they are more isolated from care, a world where they have no “choice,” a world where they are abandoned to their abusers. Worst of all, this is accomplished under the guise of reproductive “freedom” the letter states. “We urge you to protect these vulnerable women and children by sending a cease-and-desist letter to three online pharmacies illegally shipping abortion drugs as well as their four shield law providers.

Several states – Massachusetts, Washington, Colorado, Vermont, New York and California – enacted “shield laws” protecting rogue pharmacies from prosecution by other states when they smuggle abortion drugs into these states. These laws deprive women of legal remedies against

out-of-state abortion pill providers when they are injured or even killed from medical emergencies or forced abortions caused by the drugs.

“Now, anyone can have the high-risk abortion drugs delivered to their front door without seeing a doctor—leaving women and girls more isolated and alone than ever before,” the letter states. “The news is replete with stories of criminal convictions of men who poisoned their pregnant partners and children with mail-order abortion drugs.”

Human Coalition Action’s letter makes clear federal laws prohibiting the mailing or shipping of abortion drugs across state lines trumps any state “shield laws” that purportedly grant immunity to providers illegally shipping abortion pills. The letter also includes testimonies of Human Coalition clients who suffered life-threatening complications from the abortion pill regimen.

“Nurses at Human Coalition, an organization with a comprehensive care network assisting pregnant women and families, see first-hand the devastating effects the abortion pill has on women,” the letter states.

The group AidAccess was reportedly responsible for 85,000 mail-order chemical abortions in the year 2023, and shipped tens of thousands of “advance” doses to women seeking them in the event they became pregnant. This results in women having chemical abortions all alone at home, without receiving any care from a doctor in the process – despite the FDA’s mifepristone label reporting a 1-in-25 hospitalization rate. Chemical abortions now account for more than half of reported abortions in the United States.
