From the front lines of pro-life advocacy, women join together in a brief to the Supreme Court in Dobbs v. Jackson. The amicus brief spotlights the science of life, the major flaws of abortion precedents, and the vast societal impact 48 years of legalized abortion wrought.
“Abortion commodifies humans—pregnant mothers and their unborn children,”
Students for Life and Human Coalition Action brief.
WASHINGTON, D.C. (07-29-2021) – Students for Life of America and Human Coalition Action announced today the filing of an amicus curiae (friend of the court) legal brief prepared by Human Coalition Action attorney Chelsey Youman. It directly challenges the “egregiously wrong” Roe v. Wade and Planned Parenthood v. Casey rulings that have continuously harmed society since they were handed down by the Supreme Court. The brief calls for the Court to rectify these flawed precedents by upholding the Constitution in Dobbs.
“Continued fidelity to the Roe/Casey regime is extraordinarily disruptive to a functioning and healthy society,” the writer notes, adding later “a fetus in the womb is a distinct living human person—simply a very small one.”
The brief points out that Black and minority communities have paid a tremendous price in lives lost, a consequence of the racist agenda of U.S. abortion industry architects such as Planned Parenthood’s founder Margaret Sanger. The amicus observes, “Justice Thomas’ devastating rendering of the history of eugenics and abortion aptly depicts abortion as a tool eugenicists utilized to extinguish minority populations whom they deemed ‘unfit’.”
Also discussed are the false messages conveyed by the abortion lobby about both the science of life and the abilities of women who are targeted for an abortion sale with messages that they can’t succeed in life at both home and work.
“Amici adamantly reject any pretense that women must rely on abortion to further their circumstances or life. Amici advocate on behalf of capable, intelligent, skilled and strong women facing unexpected pregnancies every day. But what is unexpected is not therefore unwelcome or even necessarily surprising and can lead to great joy with the kind of effort that life requires. Regardless of the sometimes considerable challenges they face, they are able. Able to parent, able to work, able to succeed, able to obtain medical care, able to create incredible lives for themselves and their children. We are women. We believe in women. We serve women. We advocate for women.”
“As head of an organization primarily powered by women, many of whom are mothers, and working with the generation of women most targeted for abortion in all 50 states, I’ve witnessed the misogyny of abortion that tells women they can’t succeed without sacrificing their children,” said Students for Life of America President Kristan Hawkins. “The Supreme Court’s dangerous and erroneous conclusions made by seven men about what women need has harmed generations of women who deserve support, not the devastation of abortion. Students for Life stands with the Pro-Life Generation in making sure that women know that many are ready to help.”
Human Coalition Action’s Chelsey Youman stated, “This Court cannot turn a blind eye to the unanticipated devastation its decisions caused. And because this Court exclusively preempted this field in 1973, it is this Court’s alone to abrogate. The time has come for the Court to rectify the disastrous Roe and Casey framework and, through fidelity to the Constitution it guards, restore our ability to protect the most vulnerable among us.”
“The Supreme Court’s venerable duty is to faithfully uphold the Constitution. Our brief today argues that Roe and Casey were unconstitutionally decided, and their precedential value is weak. Roe was the catalyst for incredibly damaging consequences over the past 48 years. In that time, abortion has eroded the conscience of the American people and the fabric of our society. The Court has a clear path to overruling its abortion jurisprudence – especially in light of significant scientific developments about the humanity of the child in the womb.”
Advocating for mothers and their children, born and preborn, represents the daily work of Students for Life and Human Coalition Action. In a survey earlier this year, Students for Life of America’s Institute for Pro-Life Advancement released a survey noting that only two in ten women knew about the kinds of services and protections available to pregnant and parenting women. Nationally, SFLA’s Standing With You serves that community with resources and connections to those who can help.
